1. Introduction

These Terms of Service ("Terms") govern your access to and use of this real estate listing website (the "Platform", "we", "us", "our"). The Platform is an online marketplace where licensed real estate brokers publish property listings and where visitors can browse those listings and send inquiries.

By accessing or using the Platform, you ("you", "your", or "User") agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. About the Platform

The Platform allows you to:

• Browse and search property listings published by participating brokers
• View listing details such as photos, prices, locations, and broker contact information
• Send inquiries about listings directly to the responsible broker
• Discover brokers and organizations participating on the Platform

The Platform is a venue that connects property seekers with brokers. We are not a party to, and are not a broker, agent, or representative in, any transaction between Users and brokers.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using the Platform, you represent that you meet these requirements and that the information you provide is accurate and complete.

4. Listings and Broker Content

Listings on the Platform are created and maintained by the individual brokers who post them. Each broker is solely responsible for the accuracy, legality, and completeness of their listings, including prices, availability, property details, photographs, and contact information.

We do not independently verify, endorse, or guarantee any listing, broker, or property. Listings may be incomplete, out of date, or no longer available. You should independently verify all information before relying on it or entering into any transaction.

5. Inquiries and Communications

When you submit an inquiry, the information you provide (such as your name, contact details, and message) is shared with the broker responsible for the relevant listing so they can respond to you.

You agree to use the inquiry and contact features only for genuine, lawful real estate purposes. You must not use them to send spam, solicitations, or unlawful, abusive, or misleading content.

6. Broker Accounts

Brokers who publish listings are provided with accounts to manage their listings and inquiries. If you hold an account, you are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring you hold any licenses or authorizations required to offer the properties you list
• Posting only listings you are legally entitled to advertise, with accurate information

Notify us promptly of any unauthorized use of your account.

7. Acceptable Use

You agree not to:

• Post or transmit false, misleading, fraudulent, or unlawful content
• Infringe the intellectual property, privacy, or other rights of any person
• Scrape, harvest, or collect data from the Platform without our written permission
• Interfere with, disrupt, or attempt to gain unauthorized access to the Platform or its systems
• Use the Platform to distribute malware, spam, or unsolicited communications
• Misrepresent your identity or your affiliation with any person or entity

8. Intellectual Property

The Platform, including its design, text, graphics, and software, is owned by us or our licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Platform except as permitted by these Terms or with our prior written consent.

Listing content (such as property photographs and descriptions) remains the property of the broker or rights holder who provided it. By posting content, brokers grant us a non-exclusive license to display and distribute that content on the Platform for the purpose of operating the service.

9. Third-Party Links and Services

The Platform may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party. Accessing third-party services is at your own risk and subject to their terms.

10. Disclaimers

To the maximum extent permitted by law, the Platform and all listings and content are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:

• Listings or other content are accurate, current, complete, or reliable
• The Platform will be uninterrupted, secure, or error-free
• Any property is available, lawfully offered, or as described

Any reliance you place on listings or other content is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of or related to your use of the Platform, any listing, or any dealing between you and a broker. This includes losses resulting from inaccurate listings, unavailable properties, or transactions conducted off the Platform.

12. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to the collection and use of information as described there.

13. Suspension and Termination

We may suspend or terminate your access to the Platform, or remove any listing or content, at any time and without notice if we believe you have violated these Terms or to protect the Platform, its users, or third parties. You may stop using the Platform at any time.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of the Platform are subject to the exclusive jurisdiction of the courts of the Philippines.
